(the “PSE”).; This notwithstanding, the PSE does not make any warranty or representation whatsoever, expressly or impliedly, either as to the results to be obtained from the use of the Index and/or the figure at which the said Index stand at any particular time on any particular day or otherwise. In addition, the PSE does not make any representations and disclaims all warranties, express or implied, in respect of the Index, including, but not limited to, guarantees, representations and warranties regarding truth, adequacy, reasonableness, accuracy, timeliness, completeness, non-infringement, merchantability,  reliability, availability, satisfactory quality, suitability or fitness for any particular purpose, or any representations or warranties arising from usage or custom or trade by operation of law or non-infringement of third party rights.

Further, the PSE does not represent or warrant that (a) the use of the Index will be secure, timely, uninterrupted or error-free or operate in combination with any other hardware, software, system or date; (b) the Index will meet LICENSEE’s requirements or expectations; (c) any content will be accurate or reliable; (d) errors or defects in the Index will be corrected; or (e) the Index or the servers that make the Indices available are free of viruses or other harmful components. The Index and its contents are provided to LICENSEE without any representations or warranties of any kind.

The PSE is not responsible for and has not participated in the creation (or redemption) of product(s) that track the Indices, or in the determination of the products’ prices. The PSE has no obligation or liability in connection with the creation (or redemption), administration, marketing or trading of the product(s).

The “PSEi” mark is owned by and duly registered to the PSE. While the PSE has granted the BDO Unibank, Inc. (the “LICENSEE”) permission to use the Index and Index Trademarks in relation to its BDO PERA Equity Index Fund (“Licensed Fund”), such license does not, and should not be interpreted to, mean that the BDO PERA Equity Index Fund is recommended, sponsored, endorsed, sold, or promoted by the PSE, or that the PSE has any involvement in the creation, issuance and promotion of the same.

The PSE expressly disclaims and does not accept any liability for the results of any action taken on the basis of the Index or the use of the mark/s.

Without limiting any of the foregoing, in no event shall the PSE have any liability for any special, punitive, indirect, incidental or consequential damages (including, without limitation, lost profits), even if notified of the possibility of such damages.”
